Dear Military, Veterans and Loved Ones:

This e-mail was sent to you because you or someone you know has been affected by the horrors of the Feres Doctrine.

We have cited cases from the Atomic Veterans to the current Gulf War Veterans, which includes:

(1), Murders, (2), Rapes, (3), human experimentation in violation of the Nuremberg Code, (Atomic Testing, LSD, Anthrax, other FDA unapproved inoculations), (4), Agent Orange and Gulf War Syndrome exposures and failure to treat, (5), Abuse of Power and Gross Negligent Acts, (6), Undue Command Influence, (7), Abuse and Double Standards under the Uniform Code of Military Justice (UCMJ), (8) Falsification of Official Documents, (9), Abuse of the military’s mental health system and administrative discharge process to retaliate against service members who expose corruption and to silence claims of fraud, waste and abuse, (10), service-connected mental or physical injury or injustice from being fully identified during medical review process resulting in years of emotional and financial hardships of honorably discharged Americans seeking just and equitable benefits within the VA health care system

Kerry O'Neill's case is THE case that made this hearing possible. Kerry's case is tragic and a preventable murder if the Feres Doctrine did not allow gross or criminal medical malpractice to occur.

Justin's death, while attending Marine Corps boot camp, is yet again another case where the Feres Doctrine blanket grant of immunity allowed for gross and criminal negligence to be dismissed. Moreover, it afforded obstruction of
justice
in the investigation process wherein no justice was rendered arising from the Drill Instructor or military doctors, who are still "practicing", responsible for Justin's death, as they were never held accountable.

Please excuse my tardiness in responding to your email but I was out of the office on vacation.

The current status is that we are working on appropriate language. As you are aware, the Senator introduced language to tackle this issue. VERPA, per Barbara Cragnotti, has provided our office with language that is different than what was originally introduced. We are discussing internally which language would best fit most of the Feres cases, including your daughter’s. I’m sure Ms. Cragnotti can share the language that they provided to our office and explain whether that language would apply to Kerry’s death.

Since my e-mail to you was specifically signed "Dr," it appears that PC is not in the realm of the senator's office. I am not surprised, as attested to in the remainder of my reply....

I have waited patiently, despite my initial assessment (which has proven correct), for an update.

My calendar is marked for October 25, 2 months from your last e-mail.
This is the date I am releasing my e-mail, already prepared, re the honesty, integrity, and character of your boss. I assure you it will be spread far and wide. It is no coincidence that it is only eight days before the election. Timing is crucial.

First, I apologize for the oversight in addressing you as Mr. I meant no disrespect whatsover.

Second, you are more than welcome to contact me directly on this issue. As you know, Senator Specter has been pressing hard (and has been the only one in the Senate who has) for legislation to correct the inequities of the Feres Doctrine but ran into firm opposition from the Department of Justice and little support from fellow members on the Judiciary Committee. However, he intends to make this a priority item next year on the Judiciary Committee if and when he becomes Chairman of the committee.

(*) Also, I need to reiterate again that you and your organization need to coordinate your grassroots efforts to contact other Senators as well as House members on this issue. Senator Specter can not do this alone and any assistance from your group is greatly appreciated.

* VERPA would like to add this note: The assertion that Senator Specter cannot "do this alone" is simply misleading. All we have asked is the VERPA Act be introduced and we will do the coordinating with all Senators, as all Senators have been contacted by VERPA.

5. Senator Specter's previous Bill S. 1970 introduced in 1999 cites " negligence". We have repeatedly argued that "negligence" in the military is dereliction of duty and an issue that must be addressed under the Uniform Code of Military Justice (UCMJ) to prevent a disruption of good order and discipline. We presented the terms gross/criminal neglience which rises far above a simple mistake or negligence per se. We were informed our term "criminal" was
not defined, but we have presented 54 years of crimes against Americans service members which define our concerns without any question.

6. Congressman Barney Frank has introduced, for VERPA, a Feres Doctrine Bill to amend the Feres Doctrine. HR 2128 is currently in Congress. This Bill addresses only medical and dental malpractice. We have requested the VERPA Act, as it addresses all abuses allowed by the Feres Doctrine.

Please call Senator Specter's office at (202) 224-4254 and let the staffer who answers the phone know that you want Senator Specter to Introduce the VERPA Act. Also, please also contact your Senators and Member of Congress and ask them to Sponsor The VERPA Act.
